A PROPOSED go-kart track in Gawler could be under threat, with a major housing developer challenging the development in court.
Gawler East resident Greg Cowie had his $1 million proposal for a go-kart track and amusement centre to be built on Tiver Road, Evanston South, approved in February by Gawler’s Council Assessment Panel (CAP).
Now though, Evanston South Pty Ltd, the proprietor of land which makes up the nearby Aspire housing estate, is challenging the CAP’s development approval in the Environmental, Resources and Development Court.
In a submission against the development in December, Evanston South Pty Ltd representative Monique Webber said the go-kart track would “create adverse impacts” for surrounding homes.
“Under the current development plan, an amusement park is listed as a non-complying form of development,” the submission read.
“Further, a race track is also listed as a non-complying form of development.
“There is nothing about the proposal for an amusement park that warrants consideration for approval in a rural zone.
“We consider that a rural zone/appearance is fundamental to the visual separation between Gawler and the northern suburbs of Adelaide.
“An amusement park should be confined to a zone compatible with that land use where noise and the visual appearance can be tolerated.”
According to court documents viewed by The Bunyip, the proprietor, Mr Cowie and Gawler Council will meet on July 31, with all parties “willing to negotiate”.
In its notice of appeal, Evanston South Pty Ltd originally sought to have their appeal allowed and development consent refused.
A decision on the proposal was initially delayed in December as the CAP sought reassurance about noise impacts on surrounding properties, but members ultimately decided the plan warranted consent.
After the go-kart track was announced, Aspire residents started a petition in opposition which garnered more than 85 signatures.
The amusement park is set to include an outdoor go-kart racing track, indoor laser skirmish arena and car park and fencing upgrades.
